1 Appellant, Henry Charles Noyes, hereinafter referred to as defendant, was charged by information originally filed on the 10th day of June, 1968, with the offense of First Degree Rape in the District Court of Tulsa County, Oklahoma. On the 27th day of June, 1968, the defendant was committed to Eastern State Hospital for observation and all criminal proceedings were subsequently stayed until further order of the trial court. On or about the 7th day of January, 1969, the defendant was certified as psychotic and remained at Eastern State Hospital under treatment. On the 31st day of July 1972, the hospital notified the trial court that the defendants illness had responded to treatment and that he was considered mentally competent and able to be discharged from the hospital. On the 27th day of November, 1972, trial was commenced before a jury and the defendant was convicted of the charge and sentenced to serve a term of ninety-nine years imprisonment in the State Penitentiary. From said judgment and sentence the defendant has perfected his timely appeal.
